In order to achieve these results, there are a number of issues that need to be addressed including: –

  1. Dealing effectively with any encumbrances over the property, such as easements or covenants, to ensure that failure to disclose such encumbrances does not prejudice the sale of your property.
  2. Ensuring that any fixtures or chattels at the property are clearly addressed in the contract so that any items that you wish to retain are retained and any items that you wish to sell with the property are listed in the contract to avoid any dispute at settlement.
  3. Reviewing the contract to confirm that all statutory requirements for the issue of the contract pursuant to the Property Agents and Motor Dealers Act have been complied with. Failure to comply with the Act may jeopardise the sale of the property.
  4. Liaising with your mortgagee to have your mortgage paid out and released upon settlement.
  5. Advising you of the steps that you need to take if it is a requirement of the contract that you arrange for the tenant to vacate the property prior to settlement.
  6. Reviewing your compliance with the pool safety, smoke alarm and safety switch legislation.
  7. Assisting your real estate agent with drafting any special conditions that you, or the buyer of your property, require inserted into the contract.
